The decision to cancel tenders where unrealistically high bids from the public company Morsko Dobro were accepted is based on a new Procedure Instruction adopted on March 31, 2025—after the bids were opened, evaluated, and ranked. The tender evaluation committee initially accepted these bids as compliant and created the ranking list.
Later, Morsko Dobro received an instruction that, without any legal basis or clear criteria, considers bids above 300,000 euros suspicious. This discretionary decision effectively made bids just under that amount acceptable, while those at or above it suspicious.
By introducing new evaluation criteria after bid opening and scoring—unknown to bidders—Morsko Dobro allegedly committed serious abuses of official duty, rendering the tender process illegal. Furthermore, selective application of this instruction, by awarding contracts to some lower-ranked bidders while canceling tenders for others, raises concerns of corruption and misuse of office.
Such actions risk legal challenges that administrative courts are likely to support, giving affected bidders grounds to claim lost profits and damages. This unlawful and unprofessional conduct by Morsko Dobro’s management and government officials threatens the preparation of beaches for the upcoming season and may cause significant disruption.
