Court of Appeals rules Pljevlja Coal Mine not obligated to pay €2.37 million to Municipality of Pljevlja

The Court of Appeals has decided, in a new procedure, that RUP is not obligated to pay the Municipality of Pljevlja €2.37 million for fulfilling obligations under the Contract for Compensation for the Development of Construction Land, as reported by Pobjeda.

Earlier, the court had annulled the decision of the Commercial Court of Montenegro and ruled in favor of the Municipality of Pljevlja, obligating the Coal Mine to pay €2.37 million for fulfilling obligations under the contract signed on August 16, 2004. The Supreme Court of Montenegro accepted the Coal Mine’s request for a revision of the Court of Appeals’ ruling late last year, prompting the Appeals Court to reconsider the case and issue a new ruling stating that the Coal Mine is not obliged to fulfill these obligations.

In the remainder of the Appeals Court’s decision, the Municipality of Pljevlja’s request to obligate the defendant Coal Mine to finance the design documentation for the following projects was denied: preparation of the main project for the wastewater treatment plant in Židovići (as a continuation of the conceptual project) and the main project for treating water from the Otilovići reservoir as part of the facility at Pliješ.

The financing of investment works related to the following was also rejected: construction works on the remaining section of the sewage collector up to the location where the wastewater treatment plant in Židovići is planned; construction works on the main drinking water supply lines for the high and low zones of Pliješ, and the construction of new facilities for the water treatment plant at Pliješ.

Under the new decision, RUP is obligated to finance investment works related to the regulation of the Breznica River bed over a 600-meter stretch and the deepening of the Ćehotina River bed over a 3.5-kilometer stretch of the unregulated section, within two years from the date of receipt of the ruling under threat of enforcement.

The legal dispute between the Municipality of Pljevlja and RUP regarding the fulfillment of obligations under the 2004 Contract for Compensation for the Development of Construction Land has been ongoing since 2012.
